Learned counsel for the applicant submits that applicant is the owner of the premises from where contraband article i.e. gutkha has been seized. By referring to the order passed by this Court in Anticipatory Bail Application No. 676 of 2023 dated 06.06.2023 it is contended that the applicant is entitled for anticipatory bail on the similar lines.

Learned APP opposed the application by contending that during pendency of the present application, similar offence is committed by the applicant bearing Crime No. 265 of 2023 which shows that applicant is a habitual offender.

Having regard to the fact that during pendency of the instant application applicant has committed similar offence which shows that the applicant is a habitual offender and hence, no discretionary relief can be granted in his favour. In view of this, Anticipatory Bail Application deserves to be dismissed and it is accordingly dismissed.
