By way of present petition, the Petitioner is challenging the order dated 02.09.2022 passed by the learned Family Court, Ahmednagar, granting interim maintenance @ Rs.6000/- per month to the Respondent (wife of Petitioner).

The submission of learned Advocate for the Petitioner is that the Petitioner is Agriculturist and is not getting sufficient income. He invited attention to his affidavit of assets and liabilities, wherein he submits that his income is shown only Rs.30,000/- per year. He

37.Cri.WP.-1569-2022.doc submits that an amount of Rs.6000 is exorbitant, therefore he is not in a position to pay that much amount.

This is only an interim order at this stage, this Court is not expected to go into the factual aspects involved in the matter. It is desirable for the Petitioner to cooperate in the proceeding before the Family Court and to see that the Family Court decides his matter without unnecessary delay. There is no merit in the Writ Petition. Hence it is dismissed.

The learned trial Court to make endeavor to decide the Petition No. E-188/2021 as early as possible.
