Heard the petitioner.

The contempt is alleged of order passed by this Court on 5th June 2023. The operative part of order dated 5th June 2023, reads as under: "ORDER i) The writ petition is dismissed.

ii) In the facts of the case it is expected of the Collector to decide the proceeding afresh by following proper procedure and complete the inquiry as far as possible within one year from today. iii) In view of dismissal of the petition, connected Civil Application No.4052 of 2023 for stay does not survive and disposed off accordingly." 3.

This Court has hardly finds that any directions was issued to the learned Collector to decide the proceeding within a period of one year. It was only expected of the learned Collector to decide the proceedings as far as possible

( 2 ) within a period of one year from the date of order. 4.

Today, it is sought to be contended that since the Collector has failed to complete the enquiry within one year. He has committed contempt of the order passed by this Court. This Court hardly finds that there is any order giving positive direction to the Collector to decide the proceedings within a period of one year from today. No case is made out even to issue notice of contempt to the respondent.
