The compromise deed dated 07.02.2017 signed by the litigating sides i.e. the Petitioner/ teacher and the Education Society/ Respondent Nos.2 and 3, is placed on record. It is submitted that pursuant to the compromise deed, this petition can be disposed of. The learned Advocates, who are signatories to the compromise deed, submit that the litigating sides are present before the Court. They submit that the Petitioner is not claiming the back wages for the period 01.12.2010 to 02.02.2017.
*2* 2.wp.4205.13 The learned AGP, upon going through the copy of the compromise deed, submits that as the Petitioner is not claiming any salary or dues or monetary benefits for the period 01.12.2010 till 02.02.2017 when he was reinstated, the State Government is not required to deal with the said period to the extent of monetary claims. The copy of the compromise deed is taken on record along with all annexures (11 pages) and marked as Exhibit X for identification. Considering the above, this Writ Petition is disposed of in terms of Exhibit X.
However, it is clarified that after the proposal is sent by the Education Society with regard to the Petitioner as an Assistant Teacher along with arrears of bills/ increments, etc., the Education Department shall consider the same on it's own merits and shall pass an order in accordance with law. It is made clear that the Education Department would decide the said application without being influenced by any observation made in this order.
