This petition takes an exception to the order dated 26-08-2018 passed by the learned Magistrate, Aurangabad in PWDV No. 163 of 2014. 2.

Admittedly, against the above said order the petitioner has filed an appeal being Appeal No. 178 of 2018 before the Sessions Court, Aurangabad and same is pending.

Considering the fact that appeal is pending against the order impugned in this petition, I am not inclined to entertain the present petition. 4.

Considering the facts and circumstances of

(2) criapln3304.19 the case, hearing of the PWDV Appeal No. 178 of 2018 is expedited. The learned Sessions Court shall endevour to decide the said appeal as expeditiously as possible and in any case within a period of nine months from the receipt of copy of this order. 5.

The petition is disposed of.
