The validation proceeding is pending according to the petitioner. The employer has issued notice to submit the validity within a period of one month or else adverse action would be taken.

It is not in the hands of a litigant to get the validation proceeding decided pending before the Committee within a stipulated period. It is submitted that, vigilance has been conducted and the reply is also filed.

Considering the above, we pass following order. 4.

The petitioner shall appear before the Scrutiny Committee on 16th December, 2021. The Committee shall thereafter

2 wp 13367.21 endeavour to decide the proceeding expeditiously and preferably within a period of four (04) months from the date of appearance of the petitioner.

The respondents may not proceed pursuant to the impugned notice till the validation proceeding is decided. Of course, the employer may take further course of action depending upon the judgment that would be delivered by the Committee in the validation proceeding. The writ petition is disposed of. No costs.
