17.10.2018 P.C. :- The Sub-Divisional Officer has directed the petitioner to deposit 25% of the amount recovered from him towards the fine in respect of illegal transportation of minor minerals. By an order dated 03.10.2018 a precondition imposed by the Sub-Divisional Officer in respect of deposit of the amount is not contemplated under the provisions of Maharashtra Land Revenue Code or Maharashtra Minor Minerals (Development and Regulation) Rules 2013.

In this view of the matter, this petition stands disposed of with a direction to the Sub-Divisional Officer to decide the pending appeal presented by the petitioner on its own merits and in accordance with law as expeditiously as possible and preferably within a period of two weeks from today and it is accordingly directed.
