The learned counsel for the petitioner has placed on record letter dated 19.12.2022 and the same is taken on record and marked "X" for the purpose of identification.

The learned counsel submits that the enhancement in the instant case by the reference court over the award passed by the Land Acquisition Officer is less than 4 times and is covered within the Government Resolutions dated 03.11.2016 and 23.02.2017. The learned counsel submits that in view of the said Resolutions the State has taken policy decision not to challenge the awards of the reference court where the enhancement granted is not more than 4 times in the rural areas. In the instant case, the acquisition is from the rural area and, as such, would be covered by the said Government Resolutions. The learned counsel submits that the Government Resolutions are also applicable to the pending matters.

In view of the same, the present first appeal is dismissed as being covered within the aforesaid Government Resolutions. As there is no objection the delay is formally condoned and the first appeal is disposed of.

In view of dismissal of the appeal, the bank guarantee and the surities filed before this court would stand released.

In view of the same, all the pending civil applications are also disposed of.
