Heard learned counsel for the appearing parties. 2.

After hearing the learned counsel, it transpires that the dispute arises with respect to seniority list being maintained in respect of the employees of the management with which the petitioner had been working.

Having regard to Rule 12 of the Maharashtra SG Punde

2 29WP790.2016.doc Employees of Private Schools (Conditions of Service) Rules, 1981, as the action declaring the petitioner surplus has a nexus with the seniority, and dispute in respect of the same having been arisen, it would be expedient that the parties take a call with the Education Officer with respect to the decision on seniority amongst the employees.

In the circumstances, this writ petition is being disposed of with direction to the Education Officer to decide on the seniority claims amongst the employees of the respondent-Management leaving all points open and in case the decision is in favour of the petitioner, it would be incumbent on the management to take action in accordance with the decision of the Education Officer, of course subject to the remedial measures of the parties in respect of the said decision.

Writ Petition is accordingly disposed of.
