Applicant is convicted of the offence punishable under Sections 324 and 323 read with Section 34 of the Indian Penal Code and is sentenced to suffer rigorous imprisonment for one year and fine of Rs. 5.00/-, in default of payment of fine to suffer rigorous imprisonment for one month for offence punishable under Section 324 of the Indian Penal Code and rigorous imprisonment for six months and fine of Rs. 200/-, in default of payment of fine to suffer
- 2 - rigorous imprisonment for fifteen days for offence punishable under Section 323 of the Indian Penal Code. Fine amount is deposited. 3.
In appeal by the applicant, learned Appellate Court reduced the sentence by setting aside conviction under Section 324 of the Indian Penal Code and maintained conviction and sentence under Section 323 of the Indian Penal Code. Revision is not likely to be heard in near future considering the pandemic situation. Hence the following order :-
ORDER
i) Substantive sentence is suspended till disposal of the revision.
ii) Applicant be released on PR Bond of Rs. 15.,000/- with one solvent surety in the like amount.
iii) Bail in the Trial Court.
