Learned advocate for the applicants refers to that applicant No.1 is no more and has left behind no legal heir. The suit is for partition.

Having regard to the reasons as are appearing in the application, it would be expedient to condone the delay of 37 days caused in filing second appeal.

As such, civil application stands granted in terms of prayer clause "B" and is disposed of. Second appeal to proceed accordingly.
