PER COURT :- Learned counsel for the petitioner seeks leave to withdraw this petition, as he states that he will file an application before the learned Civil Judge to point out that the plaintiff need not be directed to adduce her evidence at this stage, as such course of action would be contrary to the Code of Civil Procedure.

If such an application is filed by the petitioner, the learned Civil Judge will decide the same, on its own merits.
