Heard the learned counsel for the applicant and the learned A.P.P. for the respondents.

The applicant seeks bail in C.R.No.0436 of 2024 registered with Bhagya Nagar Police Station, District Nanded, for the offences punishable under Sections 103, 109, 3(5) of the Bhartiya Nyaya Sanhita, 2023.

It has been alleged against the applicant that he along with co-accused Ankush had been to the place where the incident had taken place. The injured and the deceased were already there. They went there to settle the dispute. However, they had a scuffle. In that fighting, co-accused Ankush caused the injuries to the first informant and the deceased.

Considering the role attributed to the applicant it appears that he was just present there. Neither he assisted nor facilitated the co-accused for the death. There are no antecedents to his discredit. Nothing is recovered from him. Therefore, no purpose would serve by keeping him behind bar. Hence, the order:-

ORDER

i) The application is allowed.

ii) Applicant - Yogesh Padmakar Chaudhary be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He should not tamper with the prosecution witnesses. (b) He should not contact the victim or the prosecution witnesses till the trial is concluded.

(c) He should attend the police station as and when called by the Investigating Officer on written notice till filing the chargesheet.
