Heard Mr.Golegaonkar, learned counsel for the petitioner, Mr.Salve, learned counsel for Respondent No.3 and learned Additional Government Pleader for Respondent Nos.1 and 2.

Learned Additional Government Pleader has confirmed that validation proceeding in

2 W.P.No.12208/17 respect of the tribe claim of the petitioner is pending with the Committee.

Considering above, we pass the following order :

a) The Respondent No.2 Committee shall decide the validation proceeding in respect of the tribe claim of the petitioner expeditiously, preferably within four (4) months.

The petitioner shall appear before the Committee on 30.1.2018.

b) Till the validation proceeding is pending, the Respondent No.3 employer shall not take any adverse action against the petitioner only on the ground that validation proceeding is pending.

c) The Respondent No.3 employer can take further course of action depending upon the judgment that would be delivered by the Committee in validation proceeding.
