Learned counsel for appellant, on instructions, seeks leave to withdraw the appeal. He submits that he has given intimation to Mr. P.C. Mayure, learned counsel for respondent nos. 1 and 2. However, due to personal difficulty, Mr. Mayure is unable to attend the Court through video conferencing.

There is no hurdle to grant leave as prayed for. Leave granted to withdraw the appeal.

The first appeal stands disposed of as withdrawn. No costs. 4.

The Court fees deposited by the appellant be refunded as per rules.

The respondents / original claimants are at liberty to move the application ( Civil Application No.5099 of 2017) for withdrawal of remaining amount deposited by the appellant / insurance company in this Court.
