Heard the learned counsel for the applicant and the learned A.P.P. for the respondent.

The applicant seeks bail in C.R.No.236 of 2024 registered with Satara Police Station, District Chhatrapati Sambhajinagar (Aurangabad), for the offence punishable under Sections 302, 304, 109 read with Section 34 of the Indian Penal Code. 3.

The deceased was found lying dead in the verandah of the house of the applicant. The facts of the case were that the coaccused had indulged in selling liquor. The deceased was addicted to liquor. He left the house with his friend. The first informant went to the spot and tried to lift the body, but it was completely stiff. He could not lift it. Initially, the allegations were levelled against

951-BA-1912-24.odt the applicant. However, in supplementary statement he learnt from the police that the co-accused pushed the deceased as he was not going to his home back. So, he fell down in verandah and died. The applicant has a case that on the date of the incident he had been to another village.

Considering the circumstances of the case and the conduct of the deceased, the Court is of the view that no purpose would be served by keeping him behind bar. Hence, he deserves bail. Hence, the order:-

ORDER

i) The application is allowed.

ii) Applicant - Satish Ashok Bhalerao be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He should not tamper with the prosecution witnesses. (b) He should attend the police station as and when called by the Investigating Officer on written notice till filing the chargesheet.
