After having heard learned Counsel appearing on behalf of the petitioner, for some time, it is noticed that after the Trial Court posted the matter for delivering judgment, an application for setting aside "no cross" order was moved.

As this Court was not inclined to show any indulgence, learned Counsel for the petitioner makes a prayer for withdrawal of the petition, with liberty to canvass/raise such ground in a statutory appeal, if the judgment goes against the petitioner.

Writ Petition as such stands dismissed as withdrawn, with liberty as prayed for.
