ORDER:- 1.

Heard rival submissions. The applicant-wife is seeking transfer of Petition No. 374 of 2021 filed by respondent for getting divorce, from the Family Court, Solapur to the Family Court, Jalgaon.

The learned Counsel for the respondent strongly opposed the application on the ground that the applicant herself deserted him.

However, it appears that the applicant - wife has no source of income. Moreover, she is having 4 years son begottn from this marriage, to look after. Further the distance between Solapur and Jalgaon is of 450 kms and therefore, it is highly difficult for the applicant to attend the dates at Solapur especially when she is having son of tendered age. Therefore,

(2) 978 MCA-307.2021.odt considering the convenience of the applicant wife, following order is passed.

ORDER

(i) The application is allowed.

(ii) Petition A- No.374 of 2021 is hereby transferred from the Family Court, Solapur to the Family Court, Jalgaon for its disposal according to law.

(iii) The respondent is directed to appear before Family Court, Jalgaon on or before 16th January 2023.

(iv) The application is accordingly disposed of.
