I have heard the learned advocates for the respective sides and have perused the order dated 16.08.2019 passed in Writ Petition No.931/2015. The interim relief granted to the petitioner on 28.01.2015 was continued by this Court by order dated 16.08.2019. The grievance of the applicant is that the Honourable Minister is now busy in elections and is engrossed in campaigning. The protection may, therefore, be continued at least till the application for interim relief is decided.

The learned advocate for respondent no.5 has strenuously opposed this request and prays for rejection of the application with heavy

I find that the request made by the applicant is justified. The applicant was protected by the orders of this Court from 28.01.2015 for a period of more than four and half years. It is only in fortuitous circumstances that the Honourable Minister is not available for taking up the matter in view of the Maharashtra State Assembly elections scheduled on 21.10.2019.

In view of the above, this Civil Application is allowed and the protection granted by this Court by order dated 28.01.2015 is continued upto 30.11.2019. It is expected that prior to 30.11.2019, the Honourable Minister would decide the application for interim relief filed by the applicant herein on it's own merits.
