Applicant submits that he has suffered head injury in the motor vehicular accident. Apart from various other ailments, he is facing financial duress and due to that he could approach this Court within time. Notice of this application is served upon respondent/MSRTC. The averments in the

920ca12648.24 application are not controverted by filing affidavit-in-reply. In that view of the matter, a case is made out to condone delay. Resultantly, application stands allowed. Delay of 762 days caused in filing appeal stands condoned. The Civil Application stands disposed off. Appeal be registered.
