Heard learned counsel for the parties. Perused case papers.

Applicant is involved in Crime No.9 of 2015 registered at Erandol Police Station, Taluka Erandol, District Jalgaon for the offences punishable under Sections 302, 201, 120-B read with 34 of the Indian Penal Code.

At the outset it is to be mentioned here that Criminal Application No.3650 of 2015 filed before this Court by Applicant was withdrawn and the same was dismissed vide order dated 24th July, 2015. Paragraph No.2 of order dated 24th July, 2015 reads as under: "2] When the court was about to dismiss the application for bail, the learned counsel Shri Patil submits that he has instructions to withdraw the present application. Permission granted."

915 appln.5903.15.odt Vide order dated 19th November, 2015 this Court had asked learned APP to seek instructions regarding present status of Sessions Case No.69 of 2015 from the concerned Court. Learned APP Mr.A.R.Kale makes a statement upon instructions that trial of Sessions Court has commenced, examination-in-chief of Complainant has been recorded and Sessions Case is now fixed for cross-examination of Complainant.

In view of the above grievance made by Applicant can be taken care of by passing the following order -

O R D E R

I.

Criminal Application No.5903 of 2015 is disposed.

II.

Trial Court to expedite the trial and dispose of Sessions Case No.69 of 2015 within a period of six months from the date of receipt of this order. [ INDIRA K. JAIN, J. ] ndm
