The name of the petitioner is not included in the Shalarth Pranali only on the ground that validity certificate is not submitted.

Mr. Bolkar, the learned counsel for the petitioner submits that, the tribe claim of the petitioner is invalidated. He has filed Writ Petition No. 8983 of 2018. This Court under order dated 06th August, 2018 has issued notice and directed the respondents therein not to take adverse action against the petitioner. The said order is still in force according to the learned counsel for the petitioner.

The learned Assistant Government Pleader for respondent Nos. 1 to 4 submits that, as validity certificate is not submitted,

2 wp 13458.21 the respondents have rightly not included name of the petitioner in Shalarth Pranali.

As interim order is operating and the petitioner is in service, so also appointment of the petitioner is approved, then in that case subject to the decision in Writ Petition No. 8983 of 2018, the respondent No. 3 can consider inclusion of the name of the petitioner provisionally in the Shalarth Pranali. 5.

The respondent No. 3 shall reconsider the said aspect for inclusion of name of the petitioner in Shalarth Pranali in tune with the observations made herein and take decision on its own merits, expeditiously and preferably within a period of two (02) months from today.

In the light of the above, the writ petition is disposed of. No costs.
