Learned Advocate for the applicant is absent, however, the application is for condonation of delay of 28 days in filing the criminal appeal. It will not be out of place to mention here that it appears that after the matter was filed in 2018, it was not even taken for circulation. Accused appears to be in jail as he has been convicted for the offence punishable under Section 302 of the Indian Penal Code and has been sentenced to suffer rigorous imprisonment for life.

Even in spite of absence of learned Advocate for the applicant we can deal with the application as it is restricted to condonation of delay. The reasons for the delay those have been stated that due to financial constraints, his relatives are resident of Karnataka, nobody resides in Aurangabad and poor financial condition. These are all good grounds to condone the delay. Hence, the application stands allowed and disposed of. Registry to verify and register the appeal.
