This matter was heard for some time.
The nomination forms and the decision of the Returning Officer declaring that the Petitioners will be contesting the election from the General Category as was mentioned in the nomination forms, have been considered.
It is just 48 hours in between today and the polling date which is 07.10.2017.
The learned Advocate for the Petitioners, therefore, submits on instructions that the Petitioners be permitted to withdraw this petition with liberty to prefer an election petition for challenging the election of those candidates in the backdrop of the grievance raised by the Petitioners
*2* 903wp12084o17 in this petition. It is further prayed that if an election petition is filed, the same may be expedited to be decided within a particular time frame. Considering the above, this Writ Petition is disposed of as withdrawn with liberty as prayed for.
If the Petitioners prefer an election petition or any other proceeding, as is permissible in law, for challenging the election of those candidates, the concerned authority dealing with such an election petition or proceeding, shall decide the same as expeditiously as possible and preferably within a period of TWO YEARS from the date of filing of such proceedings.
Needless to state, all contentions, averments and grievances put forth by the Petitioners in this petition are kept open. kps (RAVINDRA V. GHUGE, J.)
