Applicants seek withdrawal of amount of Rs.29,26,093/- deposited by the resondent No. 1/Acquiring Body in this Court. It is submitted by the learned counsel for the applicants that the enhancement is reasonable and the claimants are entitled to receive the amount.

Application is contested by the learned counsel for the respondent No. 1. It is submitted that the respondent No. 1 has

2 92 ca 10967.25 every hope of success in the appeal. It would be difficult to recover the amount if acquiring body succeeds in appeal. 4.

Considering overall circumstances, I find it fit to permit the applicants - claimants to receive 75% of the amount deposited with accrued interest on furnishing undertaking to the satisfaction of the Registrar (Judicial) of this Court. Balance amount shall be invested in any nationalized bank. The civil application is disposed of.
