Heard the learned Advocate for the petitioner. By the impugned order the Family Court has directed the petitioner/husband to pay interim maintenance of Rs.8,000/- per month to the respondent/wife. The learned Advocate for the petitioner submits that he is facing severe medical problems and also will have to bear the expenses for treatment. He is not able to pay Rs.8000/- per month as interim maintenance.

Perused the order passed by the learned Trial Court. The learned Trial Court has taken into consideration the properties available, so also the account statement of the petitioner and educational qualification of the petitioner, and arrived at a finding that the petitioner is earning more than Rs.55,000/- per month since the

WP 12273-2022 petitioner has shown his monthly expenses as Rs.55,000/-. It is also held that the wife of the petitioner is also not earning. As such, I do not find any error in the order passed by the Family Court directing payment of Rs.8000/- per month as interim maintenance. 3.
