1] The learned counsel for the respondentcaveator, so also, learned AGP for the respondent-State point out that against the impugned order, remedy of Appeal is available to the petitioner to challenge the impugned order before the State Authorities under Section 247 of the Maharashtra Land Revenue Code.

2] Considering the submissions made by the learned counsel for the respondents, the learned counsel for the petitioner submits that he seeks leave to withdraw the present Writ Petition, with liberty to challenge the impugned order before the appropriate Authority. The learned counsel for the petitioner further submits that the time spent in prosecuting the present Writ Petition may be

12743.25WP excluded under Section 14 of the Limitation Act for computing the period of limitation in filing the appropriate proceedings before the authority.

3] Leave granted. The Writ Petition is dismissed as withdrawn, with liberty as aforesaid.

4] In the event such proceedings is filed by the petitioner to challenge impugned order within eight weeks, the time spent in prosecuting the present Writ Petition be excluded under Section 14 of the Limitation Act for computing the period of limitation in filing the appropriate proceedings before the authority.
