The learned counsel for the applicant submit that these are two writ petitions one is filed by the private party/present petitioner and another by the Aurangabad Municipal Corporation.

The learned counsel for the petitioner in Writ Petition No. 11380 of 2014 informs that the dispute has been settled amicably and he has instructions to withdraw this petition. He further submits that he undertakes to withdraw suit bearing R.C.S. No. 77 of 2013 pending before the Corporation Court at Aurangabad.

The petitioner has deposited an amount of Rs. 1,00,000/- in this Court to demonstrate its bonafides. In view of request for withdrawal of the writ petition he seeks permission to withdraw the amount also.

The learned counsel Mr. Amit Vaidya representing the Corporation does not have any serious objection. 5.

The Writ Petition No. 11380 of 2014 is disposed of as withdrawn. The amount deposited in this Court shall be refunded to the petitioner along with accrued interest, if any. [ SHAILESH P. BRAHME, J. ] bsb/Dec. 23
