CORAM : R. G. AVACHAT AND ABASAHEB D. SHINDE, JJ.

DATED : OCTOBER 03, 2025 P.C.:

1.

Heard.

2.

By the present Writ Petition under Article 226 of the Constitution of India, the petitioner is challenging the order dated 18.07.2019 passed by Respondent No.2-Committee thereby invalidating the caste claim of the petitioner belonging to 'Koli Mahadev', Scheduled Tribe. 3.

The learned Counsel for the petitioner has invited our attention to the order passed by this Court in the case of Pooja Shivaji Nagrale Vs. The State of Mahrashtra & Ors. in Writ Petition No. 12194 of 2019 and Ashvin Dhondiram Nagrale Vs. The State of Mahrashtra in Writ Petition No.12196 of 2019, wherein this Court vide order dated 25.02.2021 has granted validity in favour of these petitioners. 4.

It is a matter of record that the caste claim of the petitioner along with those two petitioners was rejected by a common order and therefore considering the fact that this Court in the matter of Pooja Narwade/

969-wp-12195-2019.odt Shivaji Nagral (supra) and Ashvin Dhondiram Nagrale (supra) has already passed order thereby validating the caste claim of the said petitioners. We have to adopt the same course by allowing this Petition and setting aside the impugned order dated 18.07.2019 passed by Respondent No.2-Committee. Hence, the following order :- : ORDER :

i.

Writ Petition stands allowed partly.

ii.

Impugned order dated 18.07.2019 is quashed and set aside. iii.

Respondent No.2-Committee is directed to issue caste validity certificate in favour of the petitioner belonging to 'Koli Mahadev', Scheduled Tribe.

iv.

The validity shall be co-terminus with the validity certificates of the blood relations, relied on therein.
