The petition had been heard earlier on, to a considerable extent and change of Advocate had been mooted by petitioners. Thereafter, despite several dates, no efort to cause appearance on behalf of petitioners has been made.

It appears to be a case wherein petitioners' land had been acquired by Maharashtra Industrial Development Corporation way back in 1996 under private negotiations.

Mr. Dande, learned counsel for respondent no. 5 submits that the land had vested in State under acquisition. Thereafter, plots have been allotted by MIDC to respondents no. 3 and 4 to be used for the activities as allowed under law. After acquisition, twenty years down, petition has been moved claiming that the acquired land has

2 WP / 236 / 2017 not been put to use for the purpose of acquisition and is being used for some other purpose.

In the circumstances, having particular regard to the conduct of petitioners, that after hearing, change of Advocate had been mooted and despite that, no appearance has been caused on behalf of petitioners. The petition is dismissed. Consequently, pending civil applications no. 15292 of 2017 and 8967 of 2018 also stand disposed of.
