VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Petitioners : Nagargoje Ankush N. AGP for Respondent/State : S.K. Tambe ...
CORAM : T.V. NALAWADE, J.
DATED : 29th November, 2016.
ORDER :
1.
The present proceeding is filed to challenge the order made by the Inquiry Officer under section 88 of the Maharashtra Co-operative Societies Act, 1960. The Inquiry Officer has exonerated the Directors in respect of the irregularities and illegalities alleged against them. There is provision under section 152 of the aforesaid Act to file appeal against such order made by the Inquiry Officer. When appeal is decided by the appellate authority, there will be another provision available under section 154 of the aforesaid Act like revision to the State Government. As the appellate authority has power to deal with the factual aspect, this Court holds that it is not desirable to entertain the writ petition. The petition stands dismissed with liberty to file proceeding before the appellate authority.
