The validation proceeding in respect of tribe claim of the petitioner is pending since October 2016. Same is not yet decided.

Mr. Thigle, the learned counsel for the respondent No. 3 submits that, the petitioner has not paid fees due and payable by him.

As validation proceeding is pending, we pass following order.

The Scrutiny Committee shall decide the validation proceeding in respect of tribe claim of the petitioner on its own

2 wp 12187.19 merits, expeditiously and preferably within a period of six (06) months from the date of the appearance of the petitioner. The petitioner shall appear before the Committee on 24th December, 2019. The respondent No. 3 shall not withhold the marks sheet of the petitioner only on the ground that validation proceeding is pending. The petitioner shall file an undertaking with the respondent No. 3 that in case his tribe claim is invalidated, then he will pay the full fees.

In view of the above, the writ petition is disposed of. No costs.
