This contempt petition is filed in the year 2022. It was on board dated 14th December 2022, 10th January 2023, 2nd March 2023. On all these dates, none appeared. On 30th March 2023, the petitioner was heard on maintainability and the matter was adjourned to 3rd April 2023 for passing orders. Petition, however, could not be taken up thereafter due to paucity of time.

Today, when the matter is called out in the morning sessions, none was present. Even in the second session, when the matter is called out,

( 2 ) 27-CP-798-2022 none is present. Till now, the petitioner has not addressed this Court on the maintainability of the contempt petition. 3.

This Court has seen the prayers and the petition. No specific allegation is made about disobeying any order of this Court or any Court subordinate to this Court. It is the allegation that while deciding the application at Exh.51 in RCS No.94 of 2014, the learned Civil Judge, Junior Division, Aurangabad, dealing with the suit, did not consider the judgments referred to by the parties. It is, therefore, alleged that contempt is committed.

This Court hardly finds that the said can be said to constitute contempt of order passed by this Court. When this Court has directed the petitioner to address it on maintainability, the petitioner has failed to address this Court. Petition is therefore dismissed and disposed off. [KISHORE C.
