Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is apprehending arrest in connection with FIR No.0163/2024, dated 25/05/2024, registered at Mukhed Police Station, District Nanded, for the offences punishable under sections 306, 385, 387 r.w.34 of the Indian Penal Code.

This Court, by order dated 18/11/2024, granted interim protection to the applicant for the reasons mentioned in paragraph 3, namely that the victim did not mention the name of the applicant in the suicide note or the video recorded by him, although prima facie, the victim knew the applicant. This Court also directed the applicant to remain present before the Investigating Officer from 25/11/2024 to 29/11/2024 and thereafter as and when called by the Investigating Officer. 4.
The learned Counsel for the applicant submits that the applicant remained present before the Investigating Officer and that there is no 1 of
39 ABA 1768-2024 grievance regarding the applicant's presence or cooperation with the investigation.

The learned APP submits that the applicant threatened the victim on 21/05/2024 and, along with others, threatened the deceased on 27/05/2024. This fact was also noted in the order dated 18/11/2024 by this Court, which further observed that the victim left a suicide note as well as a live video recorded by him.

Prima facie, it cannot be said that the applicant intended the consequences of the deceased committing suicide when the money was demanded from the deceased. The interim protection granted on 18/11/2024 stands confirmed.

In view of the above, the application is allowed in the following terms : - i] In the event the applicant is arrested in connection with FIR No.0163/2024, dated 25/05/2024, registered at Mukhed Police Station, District Nanded, for the offences punishable under sections 306, 385, 387 r.w.34 of the Indian Penal Code, he shall be released on bail on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court.

39 ABA 1768-2024 ii] The applicant shall attend the police station as and when called by the police.
iii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. iv] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court. 8.
In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 9.
It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove. 10.
The application stands disposed of.
