By this petition, petitioner challenges judgment and order dated 28/09/2016, passed by learned District Judge-5, Nanded, in Misc. Civil Appeal Nos.69/2015 and 70/2015, by which the order passed below Exhibit-5 in R.C.S. No.357/2015 is quashed and set aside.

Learned advocate for petitioner has placed on record the order dated 12/07/2022, passed by learned 3rd Joint Civil Judge, Senior Division, Nanded, below Exhibit-1 in R.C.S. No.357/2015, wherein the suit itself is dismissed for want of prosecution. This order is marked as 'X' for the purpose of identification. 3.

In view of order dated 12/07/2022, nothing survives in the writ petition. Writ petition is, therefore, disposed of as infructuous.
