Mr. P. D. Jarare, learned Counsel for the Applicant in ABA/1626/2023, submits that he did not argue on the point recorded in paragraph no. 4 of the order dated 23rd October, 2023 with regard to the period for which the Applicant was functioning as District Deputy Registrar.

The notes taken by this Court indicate that the point was argued however, it is not reflected the

SMP.odt way the argument was advanced. Learned Counsel for the Applicant submits that learned Senior Counsel while making his submissions had referred to the fact with regard to the period of disbursement of loan and it was not the claim of the Applicant that he was not functioning as District Deputy Registrar during the relevant period.

Hence, in view of this, submissions to that effect from 5th line of paragraph no. 4 of order dated 23rd October, 2023 stand deleted.
