This is an application seeking suspension of sentence awarded by the learned Special Judge, ACB and Additional Sessions Judge Shahada, Dist. Nandurbar in Special Case No. 23/2014, wherein the Applicant is held guilty for the offences punishable under Sections 7 and 13(2) of the Prevention of Corruption Act. He sentenced to suffer simple imprisonment for one year and to pay a fine of Rs.5000/-, in default to suffer S.I. for two months, for each section.

Learned Advocate for the Applicant submits that the Applicant has already deposited the fine of amount on the date of judgment and order. He was on bail during trial. There is no complaint of any misuse of his liberty. He further submits that the learned trial Judge has also suspended the sentence till the appeal period is over vide its order dated 02.11.2022.

Considering that he prays for suspension of sentence. Hence the following order.

O R D E R

(i) The substantive sentence awarded by the learned Special Judge, ACB and Additional Sessions Judge, Shahada, Dist. Nandurbar in Special Case No. 23/2014 by judgment and order dated 02.11.2022, stands suspended till appeal is finally decided. (ii) The Applicant shall submit fresh bail bond in the trial Court.
