The petition is filed for giving direction to respondents, who include the employer, and also Education Department of the State to give status of Trained Graduate Teacher to the petitioner w.e.f. 14.06.1999. A direction is also claimed against them to pay the arrears of salaries after giving that scale w.e.f. 14.06.1999. Both the sides are heard. 2.

The submissions made and the record show that the petitioner came to be appointed as Assistant Teacher on

(2) WP No.6343/2014 probation basis on 07.10.1998. The appointment was given in D.Ed. Scale as D.Ed. scale post was available. He was B.A., B.Ed. (Physical). In view of the standards which the School was having and the subject which the petitioner was having, the post did not become available to him of Trained Graduate Teacher. Ultimately the post became available on 01.12.2009 and the said post came to be given to him. As the School was the Secondary School, the teachers are approved subject-wise and in view of the circumstance that the petitioner was having the subject for which the workload became available in 2009, the post was given to him of B.Ed. Scale.
