Mr. Mohit Deshmukh, learned counsel for the appellatns along with appellants/claimants and the learned counsel Mr. S. V. Kulkarni advocate for the respondent No. 2/Insurance Company along with representative of the respondent No. 2/Insurance Company namely Mr. Idrees Khan are present today.

The parties have amicably settled the claim. The learned counsel and the parties who are present have placed on record the terms of settlement. Same is taken on record and marked as Exhibit - X for identification.

With the assistance of the learned counsel, we have verified the terms of settlement and identified the parties.

The respondent No. 2/Insurance Company has already paid the awarded amount to the appellants. Now as per the agreed compromise, the respondent No. 2/Insurance Company shall pay an amount of Rs. 4,00,000/- (Rs. Four Lakhs only) towards full and final settlement to the appellants/claimants. The respondent No. 2/Insurance Co. undertakes to deposit the said amount within a period of six (06) weeks from today in this Court. On depositing the amount, the appellants/claimants are at liberty to withdraw the same. The appellants are entitled to withdraw the amount in equal proportion.

The first appeal stands disposed of in terms of settlement and the minutes of the order passed today.

The court fees be refunded as per rules.

7.

Award be drawn up accordingly.
