IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 12763 OF 2018 Mr. Mehul Rajaram Soudagar ...

Petitioner

Versus

Mrs. Ashwini Mehul Soudagar ...

Respondents Mrs. R.R. Mane, Advocate for the Petitioner.

Coram : N.M. Jamdar, J.

Date : 28 November 2018.

Oral Order :

1.

Heard learned counsel for the petitioner.

2.

Petitioner is the husband who has filed petition challenging grant of maintenance of Rs. 5,000/- per month in favour of the respondent-wife. Learned Civil Judge, after considering the record has found that grant of maintenance of Rs. 5,000/- per month is an equitable order considering the status of the parties. 3.

From the arguments that have been advanced at bar on

dyb 2 WP12763-18dt 28-11-2018 behalf of the petitioner, it is clear that petitioner is working in private sector. Considering the cost of living as on today and considering the scope of Article 227 of the Constitution of India which is to interfere if there is failure of justice and not to correct every error, no interference is warranted in the impugned order. Writ petition is accordingly rejected.
