This is an application seeking permission to withdraw the amount deposited by the respondent/M.S.R.T.C in this Court as per the impugned judgment and award.

Perused the application. Heard learned Advocates for both the sides.

Learned Advocate Mr. Narayan Chavan h/f Mr. D. S. Bagul for the respondent strongly opposed the application and submitted that there is delay caused in filing the First Information Report. 4.

Considering the peculiar set of facts and reasons stated in the application, Civil Application deserves to be partly allowed. Hence following order:

Civil Application is partly allowed.

b.

Applicant is permitted to withdraw 50 percent amount out of deposited amount alongwith interest accrued thereon on furnishing usual undertaking to the satisfaction of Registrar (Judicial) of this Court.

c.

Civil Application stands disposed of.
