This is an application for anticipatory bail in Crime No.209/2019 registered with Dharmabad Police Station, District Nanded for the offence under Sections 420, 465, 468, 471 read with Section 34 of the Indian Penal Code.

The First Information Report (for short "F.I.R.") was registered on 3rd September 2021 by Arun Bhagwanrao Kumbhi. Applicant is relative of complainant. It is alleged that the applicant had introduced the co-accused to the first informant. The coaccused had assured that job would be provided to him and the informant was induced to part with amount of Rs. 11,00,000/-. 3.

Learned Advocate for the applicant, on instructions, submitted that the co-accused Sagar Rathod has deposited an

(2) amount of Rs. 7,35,000/- into the bank account of the complainant. The other accused Rajendra Prasad Tiwari has also deposited Rs. 65,000/- in the bank account of the complainant. Learned Counsel for the applicant, on instructions, submits that to show his bonafide, the applicant would deposit amount of Rs. 3,00,000/- in this Court within a period of four weeks.

The statement is accepted as an undertaking to the Court.

In view of the above, relief can be granted to the applicant under Section 438 of the Code of Criminal Procedure. Hence, the following order.

ORDER

(i) ABA No.1482 of 2021 is allowed.

(ii) In the event of arrest of the applicant in Crime No.209/2019 registered with Dharmabad Police Station, District Nanded, the applicant be released on bail on executing P.R. bond in the sum of Rs. 25,000/- with one or more sureties in the like amount.

(iii) The applicant shall deposit an amount of Rs. 3,00,000/- in this Court within a period of four weeks from today.

(iv) The applicant shall report the Investigating Officer as and when called for.

(3) (v) In the event charge-sheet is filed against accused, the amount of Rs. 3,00,000/- deposited in this Court shall be transferred to the trial Court and the said Court shall deal with the said amount in accordance with law.
