Heard learned counsel for the petitioner.

After arguing the matter for some time, learned counsel for the petitioner seeks leave to withdraw the writ petition with liberty to file an appropriate application for amendment before the Trial Court.

The writ petition is permitted to be withdrawn. Liberty is granted to the petitioner to file an appropriate application for amendment of the plaint before the Trial Court. The Trial Court to consider the said application for amendment on its own merits, in accordance with law and uninfluenced by the observations made in the order dated 26th September, 2022. The writ petition is dismissed as withdrawn.
