The order passed by the Scrutiny Committee refusing to entertain the validity proceeding is apparently correct, inasmuch as the tribe certificate of the petitioner is not in the proper format ('C' format). The committee has also noticed that there is spelling mistake in respect of the surname of the petitioner in the certificate.

We dispose of the writ petition by permitting the petitioner to apply for the attested copy of the tribe certificate from the committee within one week from today. On receipt of such application, the committee shall issue an attested copy of the tribe certificate to the petitioner. The petitioner shall, thereafter, approach the concerned Sub-Divisional Officer for issuance of tribe certificate in '

C' format with the correct spelling of his surname. The concerned Sub-Divisional Officer shall verify the fact of issuance of tribe certificate in favour of the petitioner as may be produced by him and on satisfaction that it was issued by his office, issue fresh tribe certificate with correct spelling and in 'C' format within two weeks from receipt of the application.

On receipt of the corrected tribe certificate, the petitioner shall once again apply with the committee as indicated in para 9 of the impugned communication.
