Pursuant to the order dated 13.3.2018, learned Advocate for the petitioner states on instructions and in view of the affidavit filed on 5.3.2018 that one post of Madatnis would fall vacant in the near future and respondent No.4 would be accommodated as per the policy of compassionate appointment framed by the State Government. In so far as the contention of respondent No.4 that the post of Smt. Sarde is vacant from 2016 is concerned, learned Advocate for the petitioner submits that the said post was an excess post and is not to be filled in for the said reason.

Considering the statement made by the petitioner in view of the affidavit tendered, the grievance of respondent No.4 is taken care of. Learned counsel submits on instructions from her that this petition can akl/d

BENCH AT AURANGABAD 2 - WRIT PETITION NO. 12999 OF 2017 be disposed off and the respondent would be willing to be inducted in employment, in view of the statement recorded by this Court on 13.3.2018.

Considering the above, this petition is partly allowed in view of the statement made by the petitioner as recorded above. The impugned judgment of the Industrial Court dated 23.7.2017 stands modified in view of the said statement.

The amount of costs of Rs.5,000/-, is being paid directly by the petitioner to respondent No.4.
