The petitioner has been granted temporary bail vide order dated 8th November, 2022 for a period of four months. The same was extended vide order dated 26.04.2023 upto the end of July, 2023. 3.

The learned advocate for the petitioner submits that the said order has also been extended until end of six months. According to the learned advocate, in view of some incident of the Incharge Court taking up the matter and granting bail in a case for offence punishable under section 302 of the Indian Penal Code, the Incharge Court is not taking up the application of the present petitioner for extension of bail period. The order indicates, the petitioner was granted bail on medical ground.

We, therefore, direct the Court concerned i.e. Incharge Court to decide the petitioner's application for extension of bail on its own merits.
