The petitioner is disqualified on the ground that he has not submitted the caste validity certificate within six months as required u/s 10(1-A) of the Maharashtra Village Panchayats Act, 1958.
The learned Advocate for the petitioner submits that the petitioner has been issued validity certificate of "Bhil"
scheduled tribe. However, it was after lapse of six months.

The Supreme Court in SLP (C) No.29874-29875/2016 - Shankar s/o Raghunath Devre (Patil) Vs. State of Maharashtra and ors., has stayed the
13311.17wp judgment of this court. The Full Bench of this Court has held the said condition to be mandatory. As the said judgment of Full Bench of this Court is stayed, the impugned order is quashed and set aside.
The respondent - authority is at liberty to take further decision in case the judgment of Full Bench of this Court is upheld by the Supreme Court. The writ petition stands disposed of accordingly.
No costs.
