DATED : 21 NOVEMBER 2024 PER COURT :- The petitioner, who has applied for the post of constable with the C.I.S.F. unit, is before us aggrieved by the rejection of his candidature only on the ground that the name mentioned by him in his application does not match with his 10th standard passing certificate.

We have heard both the sides.

As can be noticed, he had applied for the recruitment with name 'Gore Pavanraj Kalyan' whereas in the 10th standard passing certificate, his name appears 'Gore Pavanraj Kalyanrao'. This being the only reason for rejection of the candidature, in our considered view, it would be too technical. If individual is the same, merely

wp11652.24 -2because by way of convention some times 'rao' is added to the name of the father, his candidature ought not to have been cancelled. 4.

We see complete arbitrariness in rejecting the petitioner's candidature, albeit, it would always be open for the employer / respondent to seek and confirm his identification not only on the basis of 10th standard passing certificate but even by resorting to several other admissible documents.

We allow the writ petition.

The impugned rejection order dated 23.9.2024 is quashed and set aside.
