ORDER:- 1.

Heard the rival submissions. This is an application for condonation of delay of 863 days, which according to the applicant, caused due to his poor fnancial condition. The learned A.G.P. for respondent No. 1 and 2 strongly opposed the application. However, none appeared on behalf of respondent No.3 Acquiring Body despite service.

Considering the statutory right of the applicant and for the reasons mentioned in the application, the application is allowed and the aforesaid period of delay stands condoned, subject to condition that the applicant shall not claim any interest for the aforesaid delay period.
