The application is received through jail, making a grievance about inaction on the part of Jail doctor to provide proper medical treatment or to refer to the Government Medical College Hospital, Aurangabad.

Mrs.Kshirsagar, learned counsel is appointed through Legal Aid, who has filed proper petition.

Mr.Magare, learned A.P.P has taken instructions and states that time to time the petitioner is provided medical treatment and his weight has also now increased to 50 Kg. We have seen the report. The ultrasonography test of the petitioner shows a

suspected case of abdominal tuberculosis. It appears that from 30.7.2015 every month or some times 2/3 times in a month he is being examined in the Jail hospital and almost every month he is being referred to the Government Medical College Hospital, Aurangabad and the treatment is being given under the guidance of the expert Doctors of the Government Medical College Hospital, Aurangabad. He was also diagnosed of acute gastroenteritis with mild dehydration. He was admitted in the Government Medical College Hospital, Aurangabad on 30.9.2015 and discharged on 1.10.2015. He is also been provided with high protein diet and thereafter also thrice he has been referred to Government Medical College Hospital, Aurangabad for follow up. His weight is also increased from 40 kg to 50 kg.

Considering the above, the petitioner is being provided with medical care. As such, the Writ Petition is disposed of. The jail authorities shall continue the follow up and treatment as per advise of the Doctors.

We quantify the fees of Mrs.Kshirsagar, learned counsel as Rs.2,000/- (Rupees two thousand).
